(1) This Chapter sets forth uniform requirements for users of the publicly owned treatment works (POTW) for Provo City and enables Provo City to comply with all applicable State and Federal laws, including the Clean Water Act (33 U.S.C. Section 1251 et seq.), the General Pretreatment Regulations (Title 40 CFR Part 403) and R317-8-8, Utah Administrative Code. The objectives of this Chapter are:

(a) To prevent the introduction of pollutants into the POTW which will interfere with the operation of the system or contaminate the resulting sludge;

(b) To prevent the introduction of pollutants into the POTW which will pass through the POTW, inadequately treated, into receiving waters or the atmosphere or otherwise be incompatible with the POTW;

(c) To protect both POTW personnel who may be affected by wastewater and sludge in the course of their employment and the general public;

(d) To promote reuse and recycling of wastewater and sludge from the POTW;

(e) To provide fees for the equitable distribution of the cost of operation, maintenance, and improvement of the POTW; and

(f) To enable Provo City to comply with its Utah Pollutant Discharge Elimination System (UPDES) permit conditions, sludge use and disposal requirements, and any other Federal or State laws to which the POTW is subject.

(2) This Chapter shall apply to all users of the POTW. This Chapter authorizes the issuance of individual wastewater discharge permits; provides for monitoring, compliance, and enforcement activities; establishes administrative review procedures; and requires user reporting.

(3) This Chapter shall apply to Provo City residents and to persons outside the City who are, by contract or agreement with the City, users of the City POTW.

(4) It is the purpose of this Chapter to provide for the recovery of costs from users of the City’s wastewater disposal system for the implementation of the program established herein. The applicable charges or fees shall be set forth in the City’s Consolidated Fee Schedule.
