The Energy Department is hereby authorized to adopt Department rules pursuant to Section 12.01.060, Provo City Code, not in conflict with any law or other City ordinance, regulating the management of an electric power system clearance program throughout the City. Trees, shrubs, vines and other vegetation on private or public property that pose a risk to the installation, operation or maintenance of the electric power transmission and distribution facilities of Provo City may be trimmed or removed by Energy Department personnel, or its agents, in accordance with said Energy Department rules and regulations. Said rules may reasonably limit such interference with the City’s electric power system or restrict the planting of trees where they can conflict with the system and cause interference or damage. The Department of Energy Board will function as an appeals board in the event of dispute between the property owner and the Energy Department.
