No lot or parcel of land in the R2 zone shall have a building or structure used for dwelling or public assembly which exceeds a maximum height of thirty-five (35) feet, except that in no case shall the height of an accessory structure exceed the height of any main structure on the same lot. Chimneys, flagpoles, church towers, and similar structures not used for human occupancy are excluded in determining height. Notwithstanding the provisions above, single family dwellings which exceed the maximum height of thirty five (35) feet may be approved by the issuance of a conditional use permit upon findings of no significant loss of light, air, and views of surrounding properties, or where by reason of topography one (1) side of the dwelling may exceed thirty-five (35) feet.
