If the encroachment is not denied, but is not removed for five (5) days after the notice is complete, the City Building Inspector may remove the same at the expense of the owner, occupant or person controlling the same, and recover the City’s costs and expense, and also for each day the same remained after the notice was complete, the sum of ten dollars ($10.00), in an action for that purpose.
