(1) The Mayor shall appoint a Chief Administrative Officer (with the advice and consent of the Municipal Council) to exercise such duties as the Mayor shall prescribe which are consistent with state law. The Chief Administrative Officer shall be appointed on the basis of ability and prior experience in the field of public administration, together with such other qualifications as may be prescribed. The Chief Administrative Officer may be removed at the sole discretion of the Mayor. Except as the Mayor may otherwise direct, and except as otherwise provided in this Section, the Chief Administrative Officer may exercise the administrative powers of Provo City, including the signing of contracts. The Chief Administrative Officer may not approve or disapprove any ordinance, and may not hire or terminate any office or department head.

(2) The Chief Administrative Officer’s powers and duties may include, but are not limited to the following:

(a) Supervising the administration and enforcement of all laws, the Provo City Code and other ordinances of the City as they affect the administrative departments;

(b) Executing the policies affecting the administrative departments that are adopted by the Municipal Council;

(c) Recommending to the Mayor the hiring, disciplining or terminating of administrative department directors appointed by the Mayor;

(d) Hiring and making appointments regarding all other administrative department employees and agents and disciplining or terminating the same;

(e) Conducting performance evaluations and administrative pay adjustments as prescribed by the Provo City Code, other City ordinances or policy;

(f) Administering and exercising control of all administrative departments of the City;

(g) Authorizing the issuance of such administrative rules and regulations and out-lining general administrative procedures applicable to all areas of operation and departments delegated to the chief administrative officer’s supervision which are not in conflict with the laws of the state, the Provo City Code or other City ordinances;

(h) Attending all official Municipal Council meetings with the right to take part in all discussions as requested by the Mayor in accordance with the Council rules and decorum;

(i) Establishing procedures, to be approved by the Mayor, for the purchase of materials or services and otherwise authorizing expenditures of funds in administrative departments on behalf of the City subject to the requirements of statutes, the Provo City Code and other City ordinances now or hereafter lawfully enacted; and

(j) Performing such other duties as may be prescribed by the Mayor or permitted by law, by the Provo City Code or by other City ordinance.
