The placing of monuments and markers is done so at a purchasers’s own risk, shall be accomplished under the direction of the City Sexton, and shall comply with all specifications herein enumerated. The City assumes no obligation or responsibility to repair or replace markers or monuments damaged by an owner or third parties, or damaged as a result of a failure to comply with the directions of the City Sexton, or failure to comply with the following specifications:

(1) It shall be unlawful for any person to erect or place any monument on any lot in the City cemetery, unless the same shall be placed on a good concrete foundation eight (8) inches deep or deeper, if deemed necessary by the Sexton, with a cement apron (lawn mower strip) not less than eight (8) inches wide around said monument. For purposes of this Chapter, a monument is defined to be: any structure, tree, plant, urn or any structure designed to perpetuate the memory of the dead; all other structures erected in the cemetery lots are hereby designated as “markers.”

(2) It shall be unlawful for any person to place any monument on any lot in the said cemetery made of any material other than metal, stone or cement.

(3) All markers placed in the cemetery shall be securely set in a concrete foundation at least six (6) inches deep with a concrete lawn mower strip not less than eight (8) inches wide around the marker. The maximum length of any flush marker shall not exceed sixty-four (64) inches.

(4) It shall be unlawful for any person to place more than one (1) marker or monument on any one grave, except that a military marker may be placed just east of a double marker, flush with the ground and directly over the grave, to memorialize veteran status.

(5) It shall be unlawful to place any above-ground marker or monument in Provo City Cemetery without first paying a permit fee, which fee shall be as shown on the Consolidated Fee Schedule adopted by the Municipal Council.

(6) It shall be unlawful for any person to place more than two (2) flower vases on the grass skirt of any one monument or marker and at least four (4) inches of cement of proper depth must extend beyond such vase. When two (2) vases are put in the grass skirt of any grave marker or monument they must be placed on each side of or north and south of said marker or monument. Open holes in grass skirt or any part of the grave shall not be allowed.

(7) Memorial Park Section. That section of the Provo City Cemetery known as the “Memorial Park Section”, including Blocks 12 through 21, Provo City Cemetery Survey, shall be limited to markers and monuments installed flat and flush with the ground level. It shall be unlawful for any person to place any trees, shrubs, flowers, markers or monuments or any other things of a permanent nature in this section of the cemetery, except that fresh cut flowers or similar temporary decorations will be allowed and will be removed by the cemetery personnel within five (5) days or the next scheduled mowing.

(8) Notwithstanding anything in Subsection (7) of this Section, Block 19 and part of Blocks 13 and 21, shall be used for a mixed stone concept where all markers and monuments shall be flat and flush with the ground, except where monuments and markers have been designated to the above ground level by the Provo City Cemetery Plan drawn by the Grever and Ward, Inc., 335-316, dated March 26, 1974 and accepted by Provo City with minor revisions.

(9) In Blocks 13, 19, and 21, where above ground monuments and markers are allowed, flower cups must be placed on the side north and south of such monuments or markers. (No upright markers may be placed along State Street).

(10) The selling price for the marker and monument space for the two (2) burial lots and for the three (3) burial lots shall be as shown on the Consolidated Fee Schedule adopted by the Municipal Council.

(11) The City Sexton is authorized to arrange and to maintain trees, shrubs and other landscaping to enhance the beauty of the cemetery and the Memorial Park Section.
