(1) All service charges, costs, fees, and penalties for water, sewer, garbage collection, and electric power and all service charges, costs, fees, and penalties for the stormwater drainage service provided by the Provo City Stormwater Service District shall be billed for and collected on a single, unified bill prepared by the Department of Energy. The Department of Energy shall develop written policies and procedures for unified billing not inconsistent with this Section.

(2) All service charges, costs, fees, and penalties collected pursuant to a unified bill shall be credited to the accounts of water, sewer, garbage collection, electric power, and stormwater on a pro rata basis. The payment of less than the total amount due on any unified bill shall result in a delinquent unpaid balance for each of the itemized accounts included on the unified bill.

(3) Failure to pay when due all service charges, costs, and fees on a unified bill shall result in delinquent accounts and any or all of the following actions may be taken:

(a) Imposing a penalty of one and one-half percent (1.5%) per month accrued on the unpaid portion of the unified bill.

(b) Bringing an action at law to collect any unpaid portion of the unified bill. Every person obligated to pay delinquent portions of the unified bill shall be required to pay all costs of collection including attorney’s fees, court costs, and all other costs incident to collection.

(c) Discontinuing or disconnecting any or all of the services identified on the unified bill.

(d) Using any other remedy provided by law.
