(1) An auction as contemplated in this Chapter is a sale conducted in public competitive circumstances of any type of property by outcry to the highest bona fide bidder. An auctioneer is defined as a person who conducts an auction for any kind of compensation, fee or payment of any kind. Sales of property by public officers, attorneys as for example, under the power conveyed by state law under Section 57-1-27, Utah Code, as amended, or similar enactments, by peace officers or other designated officials under state statute, federal law or Provo City Code or other City ordinance or officials of this City duly designated for that purpose shall be exempt from the requirements of this Chapter as shall be any trustee acting pursuant to trust powers.

(2) It shall be unlawful for any person to engage in the business of auctioneering or to conduct an auction within Provo City without first procuring a license so to do. Auctioneer’s fees shall be as shown on the Consolidated Fee Schedule adopted by the Municipal Council.
