6.08.020 License Required - Scope.
(1) Except as otherwise provided in this Section it is unlawful for any person to conduct a towing or parking enforcement operation within the corporate limits of Provo City, unless the person performing such operations has a Provo City business license to do so.
(2) No Provo City business license is required to conduct a towing or parking enforcement operation authorized by the Provo City Police Department.
(3) A tow truck motor carrier or other person that has a place of business located within Provo City may not conduct towing or parking enforcement operations within the City unless the carrier or person has a Provo City business license authorizing such operations. Such license shall be applied for, granted and maintained in compliance with the provisions of this Chapter.
(4) A tow truck motor carrier that has a county or municipal business license for a place of business located within a county or municipality other than Provo City is not required to obtain a Provo City business license to conduct towing operations within the City.
(a) Notwithstanding the foregoing, a business which conducts towing operations within Provo City shall first provide the following information to the Provo City Business License Office:
(i) Business name, address, and telephone number;
(ii) Evidence of a current business license issued by another municipality or a county;
(iii) Current fee schedule;
(iv) Identification of vehicle operators employed by the business;
(v) Description, vehicle identification number, and license number of each tow truck used in the business; and
(vi) Evidence of the surety bond and property damage insurance required by Sections 6.08.040(2)(e) and (k), Provo City Code.
(b) If any of the information set forth in Subsection (4)(a) of this Section changes, the business shall deliver current information to the Provo City Business License Office within ten (10) business days following the change.
(5) The provisions of this Chapter shall not apply to a person who conducts a parking enforcement or towing service operation on the person’s property using the person’s own equipment and personnel.
