(1) Upon receipt of a complete application, a business license may be issued to a business which conducts towing or parking enforcement operations and which has a principal place of business within the corporate limits of Provo City upon proof that the applicant has met and will continue to meet the requirements set forth in Subsection (2) of this Section.

(2) The holder of a business license authorizing towing or parking enforcement operations shall continuously conform to the following conditions:

(a) Maintain a business name that is not substantially similar to the name of any Provo City department responsible for parking enforcement and tow truck services;

(b) Comply with current Utah Department of Transportation requirements for tow truck drivers and tow truck services;

(c) Maintain Department of Transportation certificates for each tow truck motor carrier, tow truck, and driver during the term of the license;

(d) Affix readable signs on the doors (except windows) of any tow truck or parking enforcement vehicle listing the name of the applicant’s business, address, telephone number, and business license number;

(e) Provide competent evidence of a surety bond of one thousand dollars ($1,000.00) from good and sufficient sureties to ensure continued compliance with this Chapter;

(f) Provide competent evidence that the tow truck service business stores vehicles in a secure fenced area, enclosed yard or building within the City limits, unless otherwise required or permitted by applicable provisions of the Utah Code or regulations adopted thereunder;

(g) Ensure that all tow trucks are operated by personnel carrying a certification card issued by the Utah Department of Transportation and a valid Utah driver’s license which authorizes operating a tow truck;

(h) Ensure that every licensee and employee of the licensee shall wear either:

(i) A readily identifiable shirt, blouse, or other top article of clothing with the name of the licensee and the first name of the employee contained thereon and readable from a distance of six (6) feet; or

(ii) A prominently visible identification badge on the front of employee’s clothing with the name of the licensee and the first name of the employee contained thereon and readable from a distance of six (6) feet;

(i) File with the Provo City Business License Office a list of current fees for all services performed by the business;

(j) Provide competent evidence that the licensee is in compliance with applicable regulations set forth in Section 9.31.110, Provo City Code; and

(k) Provide competent evidence of valid property damage liability insurance in the amount of twenty-five thousand dollars ($25,000.00) issued by an insurance company authorized to do business in the State of Utah with the applicant named as an insured, including the policy number and insurance company name.

(i) A copy of such insurance policy or a certification from the insurer as to duration, kind, and extent of insurance shall be kept on file with the Provo City Business License Office.

(ii) The licensee or the licensee’s insurance agent shall notify Provo City of any termination or change of policy within ten (10) business days thereof. Failure to do so shall be grounds for suspension or revocation of any business license issued under this Chapter.
