(1) Upon receipt of a complete application, a business license shall be issued to a business which conducts a taxicab service within the corporate limits of Provo City upon proof that the applicant has met and will continue to meet the following requirements:

(a) comply with any applicable Utah Department of Transportation rules and regulations for a taxicab service business or taxicab driver;

(b) affix readable signs on the doors of any taxicab service vehicle listing the name of the taxicab service and its telephone number;

(c) provide competent evidence of valid liability insurance coverage for each driver and each taxicab service vehicle, with minimum limits of two hundred fifty thousand dollars ($250,000.00) for one (1) person in any one (1) occurrence, five hundred thousand dollars ($500,000.00) for two (2) or more persons in any one (1) occurrence, and one hundred thousand dollars ($100,000.00) for property damage or such greater amounts as may be required by Section 31A-22-301, et seq, Utah Code, as amended, issued with the applicant named as an insured, including the policy number and insurance company name;

(d) maintain continuous vehicle insurance coverage, while the vehicle is operational, at the minimum levels of coverage required by this Section or by State statute, whichever is greater;

(e) provide a copy of such insurance policy or certificate of insurance to the Provo City business license office, including policy duration and the kind and extent of insurance; and

(f) provide a certificate that the applicant and each driver employed by the taxicab service have submitted to a criminal background check. Thereafter a criminal background check shall be performed at least annually for each driver.

(2) An application shall not be approved and no license shall be issued or renewed to an applicant if a criminal background check or application materials uncover information showing either the applicant or any driver employed by the applicant has a record of any of the following:

(a) a felony conviction based upon conduct or involvement in a taxicab service or similar business within the past ten (10) years;

(b) a conviction within the past ten (10) years of any of the following:

(i) driving under the influence of drugs or alcohol;

(ii) alcohol, or drug related reckless driving, or impaired driving;

(iii) driving with any measurable amount of a controlled substance or metabolite of a controlled substance taken illegally in the body;

(iv) automobile homicide;

(v) any criminal conviction unrelated to conduct or participation in a taxicab service or similar business which involved any of the following:

(A) any theft offense;

(B) unlawful possession of a deadly weapon;

(C) unlawful possession with the intent to deliver narcotic drugs; or

(D) violence or threatened violence against another person, including criminal sexual assault, sexual abuse, or domestic violence;

(c) conviction of reckless driving within the past five (5) years;

(d) driver license denial, suspension, or revocation for any violation concerning operation of a motor vehicle within the past five (5) years;

(e) misdemeanor conviction or licensing ordinance violation based upon conduct or involvement in a taxicab service or similar business within the past two (2) years;

(f) failure of any taxicab driver to obtain or maintain from the Utah Driver License Division a taxicab endorsement on the driver’s license; or

(g) misrepresentation of material facts in an application for a business license;

(3) The information required by Subsection (1)(c) of this Section shall be kept on file with the Provo City business license office. If at any time a policy or certificate of insurance referred to in this Section is cancelled, rescinded, or otherwise changed by the issuing company so that it no longer complies with the requirements of this Chapter, the licensee shall report that fact to the Provo City business license office thirty (30) days prior to such cancellation or change being made. The licensee shall replace said policy or certificate with another policy or certificate prior to the termination or change of the existing policy or certificate and shall provide immediate verification of that replacement policy or certificate to the Provo City business license office. Allowing insurance coverage to lapse or failing to provide proof of a replacement insurance policy shall be grounds for suspension or revocation of a business license.
