(1) If an alarm system produces four (4) or more false alarms (with or without human intervention) within a twelve (12) month period, the Fire Chief shall require the owner or operator of the subject alarm system to pay a fee as shown on the Consolidated Fee Schedule adopted by the Municipal Council for each false alarm response more than three (3) within a twelve (12) month period. An alarm permit shall be suspended for any failure by the alarm user to pay any administrative service fee and applicable late penalties imposed pursuant to this Section within one hundred twenty (120) days of the date that notice of the assessment of the service fee is mailed to the alarm user.

(2) In addition to any action which may be taken pursuant to Subsection (1) of this Section, if an alarm system produces four (4) or more false alarms (with or without human intervention) within a twelve (12) month period, the Fire Chief may suspend the alarm system user’s alarm permit if the Fire Chief determines that the alarm system in question has a history of unreliability, the continued operation of which constitutes a danger to the safety of Provo City firefighters or Provo City police officers or residents of Provo City. Unreliability of an alarm system shall be presumed upon the occurrence of ten (10) false alarms within a twelve (12) month period. A permit suspended for unreliability may be reinstated upon a showing that the conditions which caused the false alarms have been corrected. An alarm user whose alarm permit is suspended by the City shall pay a reinstatement fee of one hundred dollars ($100.00) to the City before such permit shall be reinstated. Notwithstanding the above, a fire alarm permit cannot be suspended where such an alarm is required by the building code or any statute, law or ordinance.

(3) Any action by the Fire Chief in relation to the provisions of this Section may be appealed by giving written notice thereof to the Mayor within ten (10) days of final action by the Fire Chief. Appeals shall be conducted pursuant to the provisions of Chapter 3.06, Provo City Code.

(4) It is unlawful for a person to connect or use, or cause the connection or use of, an alarm system contrary to the order of the Fire Chief as provided in this Section.
