(1) A revocable permit shall be required for any entity sponsoring a parade or special event which desires the right to vend and sell items of parade or special event paraphernalia and food items within the public right-of-way along the parade route or special event area without payment of City license fees other than a parade or special event permit processing fee. Said permit shall grant the sponsor a right to vend and sell items of parade or special event paraphernalia and food items within the public right-of-way along the parade route or special event area, subject to the following exception:

(a) Legally established businesses located along the parade route or special event area whose building premises immediately abut a public right-of-way may vend or sell inventory or promotional items within such portion of the public right-of-way. In such instances, a parade route or special event vending and selling permit shall extend only to the area between the curb lines of the street directly in front of any such business.

(2) An application for a parade route or special event area vending and selling permit shall include the following:

(a) A non-refundable processing fee as shown on the Consolidated Fee Schedule adopted by the Municipal Council.

(b) The name, address, and telephone number of the applicant.

(c) A statement describing the time, date, location, and nature of the parade or special event.

(d) A diagram identifying the proposed parade route or special event area and locations at which vending and selling is proposed.

(3) Any permit granted under the provisions of this Section shall be valid only for one (1) day before and one after the date or dates on which a parade or special event is held. Notwithstanding the issuance of a permit hereunder, no vending and selling shall occur within any public right-of-way except on the day or days of the parade or special event.

(4) Any person or entity claiming the right to vend or sell outside the public right-of-way shall comply with all applicable City and county ordinances.
