(1) Nothing in this Chapter shall affect the otherwise lawful placement of newsracks on private property.

(2) Except as provided in Subsection (3) of this Section, a newsrack may be located on City-owned property or on a publicly-owned sidewalk without a permit so long as the newsrack does not create a public safety hazard.

(3) After the effective date of this Chapter, within the special distribution area it shall be unlawful to place or maintain a newsrack on property owned by the City or on a publicly-owned sidewalk without obtaining a newsrack permit as provided in this Chapter. A newsrack located in violation of this Chapter may be impounded as provided in Sections 6.28.210 and 6.28.220 of this Chapter.

(4) Within the special distribution area, a newsrack shall be permitted, installed, and maintained:

(a) only as provided in this Chapter, and

(b) only on City-provided pedestals and trays at locations approved by the Mayor that meet the requirements of this Chapter.
