(1) If any permitted newsrack installed pursuant to this Chapter does not contain the publication specified in the application within a period of thirty (30) days after the date of installation, or if no publication is in the newsrack for a period of more than thirty (30) consecutive days, the City shall deem the newsrack abandoned and may remove the newsrack in accordance with the procedures set forth in Subsection 6.28.220 of this Chapter.

(2) In the event a newsrack distributor desires to voluntarily abandon a newsrack location, such distributor shall notify the Business License Office in writing not less than thirty (30) days prior to the date such distributor intends to abandon the newsrack. The Business License Office shall notify the next applicant on the waiting list pursuant to Section 6.28.090 of this Chapter that a space is available. If there is no waiting list for that location, notice shall be mailed to current distributors and then published per City policy and the provisions of this Chapter.
