(1) Each commercial hauler shall pay a fee as shown on the Consolidated Fee Schedule adopted by the Municipal Council to compensate for management, oversight, coordination, right-of-way maintenance, and supervision of commercial haulers. The funds collected pursuant to this Section shall be applied to the general fund of Provo City.

(2) Not later than forty-five (45) days after the end of each calendar month each commercial hauler (including Provo City when acting as a commercial hauler) shall file a written report with the City Treasurer. This report shall state the amount of all gross revenue received during the subject calendar month from the collection, transportation or disposal of solid waste in Provo City. The franchise fee payable from gross revenues shall be paid to the City Treasurer at the time said report is filed with the City Treasurer.

(3) At the request of Provo City, commercial haulers shall make their records pertaining to submitted revenue reports or franchise fee payments open for review;

(a) When Provo City wishes to review a commercial hauler’s records, it shall notify the commercial hauler within forty-five (45) days of receipt of a revenue report or franchise fee payment, whichever, is later.

(b) Selection of an independent agency or utilization of City staff to complete review will be at the discretion of Provo City.

(c) If, during review, an error is detected in the computation of the report or distribution of franchise fees by commercial hauler commercial hauler shall have 45 days to amend the revenue report or franchise fee payment.

(d) Should commercial hauler not amend revenue report in error, then Provo City is authorized to seek restitution for any amount of unpaid fees and assess additional penalties as allowed by law.

(e) Provo City may suspend or revoke a commercial hauler’s business license for up to ninety (90) days pursuant to Provo City Code, Title 6 for each violation of the requirements of this Chapter. Any commercial hauler whose license has been suspended may appeal the decision by requesting an administrative hearing under Chapter 3.06 of the Provo City Code.
