(1) Notwithstanding any other provision of the Provo City Code, each customer receiving electrical power from Provo City, and each person in privity of contract with a customer of Provo City for the purposes of receiving electrical power from Provo City, shall install and use protective devices and equipment and take all other reasonable precautions which are reasonably designed according to accepted industry standards to avoid property damage or personal injuries resulting from the use, misuse or unavailability of electrical power, or from excessive voltage, current or frequency fluctuations, noise or other failures or malfunctions in the supply of electrical power.

(2) Except as the result of its gross negligence or willful misconduct, Provo City shall not be liable to any person claiming property damage or personal injuries resulting from the use, misuse or unavailability of electrical power, or from excessive voltage, current or frequency fluctuations, noise or other failures or malfunctions in the supply of electrical power, if (or to the extent that) said property damage or personal injuries would have been prevented by compliance with Subsection (1) of this Section.
