Where property is being proposed to be developed in rural areas of the City, where other streets are not fully improved (e.g., the building of a farm house in an agricultural area) and no other properties in the immediate areas are developed with curb, gutter and sidewalk, a building permit may be issued under the following conditions:

(1) The property owner signs a waiver of protest agreement which is recorded with the property. Said agreement acknowledges that improvements are required to be installed by the property owner as outlined by the City Engineer at a later date with street development of adjacent properties in the future.

(2) If it is determined by the City to install improvements at a later date by a special improvement district, then said agreement acknowledges that the property owner has given up the right to vote against the improvement district.
