The official street map of the City, previously adopted pursuant to Section 10-9-23 of the Utah Code Annotated, 1953, as amended, shall not be interpreted to require the City to immediately acquire property it has designated for eventual use as a public street, or require a landowner to dedicate and construct a street as a condition of development approval.

(1) This Section shall not prohibit the City from doing any of the following:

(a) Requiring a landowner to take into account the proposed streets in the planning of a development proposal.

(b) Acquiring property through purchase, gift, voluntary dedication, or eminent domain.

(c) Requiring the dedication and improvement of a street if the street is found necessary by the City because of a proposed development.

(2) The official street map of the City shall not be used to unconstitutionally prohibit the development of property designated for eventual use as a public street.
