This section is included in your selections.

(1) If the duly elected Mayor should die, resign, terminate legal domicile within the corporate limits of Provo City as determined by a court of competent jurisdiction or be judicially removed from office, the Office of the Mayor shall become vacant. The Municipal Council shall within thirty (30) days after such vacancy appoint a resident of Provo City, who is otherwise qualified to be elected Mayor to fill the vacancy. The person so appointed shall serve as Mayor until the next municipal election when a successor can be elected and qualified.

(2) Municipal Council Chair, Acting Mayor. Until a successor Mayor is appointed by the Municipal Council as above provided, the chairperson of the Council shall be the acting Mayor.

(3) Absence or Incapacity of the Mayor. The absence of the Mayor from the City or the temporary physical or mental incapacity of the Mayor shall not be deemed to cause a vacancy in the Office of the Mayor. However, if the Mayor shall judicially be determined to be totally or “permanently” incapacitated (either physically or mentally) to an extent that the said elected or appointed Mayor cannot perform the mayoral functions for the remainder of the unexpired term, the office of the Mayor shall be deemed vacant and shall be filled, as above described in Subsection (1) of this Section.
