(1) It shall be unlawful for any contractor to either submit a bid on a public improvement contract or to do work for a private person that involves cutting into and disturbing the public streets without first having prequalified by meeting each and every qualification set forth by the Engineering Division of the Public Works Department.

(2) “Prequalification” shall be deemed to require that before any bid is offered or any work in the public streets is done that the contractor shall have on file with the Engineering Division of the Public Works Department completed contractor prequalification requirements and forms which at a minimum shall include:

(a) a copy of the contractor’s license issued by the State of Utah;

(b) a continuous ten thousand dollar ($10,000.00) performance bond covering the period of time during which all work is performed, in a form to be prepared and available at the engineer’s office;

(c) workers compensation, automobile and public liability insurance with added “Underground” coverage if the work to be done includes excavating in the public streets or adjacent thereto; and

(d) a contractor’s proof of responsibility form to be filled out and duly executed and filed with the Engineering Division of the Public Work Department.

(3) All City inspectors, employees of the Public Works Department and City law enforcement personnel including zoning compliance officers are hereby authorized to enforce the provisions of this Section.

(4) Any contractor attempting to bid on a public improvement contract without first having prequalified prior to the time of the opening of bids shall be disqualified and such contractor’s bid shall be void.
