(1) Any payment or non-payment under this policy will not restrict or preclude the City’s right to file for reimbursement and/or compensation under any applicable insurance policy.

(2) The City maintains the right to proceed against a third person(s) deemed to be responsible for any accident or incident for which a claim was paid by the City under authority of any of the provisions herein.
