The following terms as used in this Chapter shall have the meanings indicated; provided, however, in the event of a conflict between a definition in this Chapter and a definition set forth in Section 72-9-102, Utah Code, the latter definition shall apply.

“Authorized vehicle” means a vehicle parked on private property for which permission has been granted to park such vehicle.

“Boot” means use of a device by a parking enforcement or tow truck service business to temporarily immobilize, disable, or electronically monitor a vehicle for purposes of enforcing parking restrictions.

“Motor carrier” means a person engaged in or transacting the business of transporting passengers, freight, merchandise, or other property by a commercial vehicle on a highway within the State of Utah and includes a tow truck service business.

“Parking enforcement operation” means providing parking enforcement services for compensation within the corporate limits of Provo City.

“Parking enforcement service” means the practice of booting vehicles without the owner’s consent for the purpose of enforcing parking restrictions on public streets, private property, or public parking lots restricted as to use.

“Person” means an individual, a firm, a partnership, a corporation, a company, an association, or a joint stock association.

“Tow truck” means a motor vehicle constructed, designed, altered, or equipped primarily for the purpose of towing or removing damaged, disabled, abandoned, seized, or impounded vehicles from a highway or other place by means of a crane, hoist, tow bar, tow line, dolly, tilt bed, or other means.

“Tow truck service” means the functions and any ancillary operations associated with recovering, removing, and towing a vehicle and its load from a highway or other place by means of a tow truck.

“Towing operation” means providing tow truck services for compensation within the corporate limits of Provo City, whether or not the towing extends beyond the City limits. Towing operations also include the storage of a towed vehicle, pending its return to the owner thereof by the person or the agent who towed such vehicle.
