The Provo City Cable Television Board is authorized to design a performance evaluation procedure which periodically monitors compliance of the franchised MCS provider with the terms and conditions of both the franchise and this Chapter. Moreover, the Cable Television Board may periodically review, and examine whether a franchised MCS provider’s financial, technical, legal, and character qualifications continue to meet required operational, maintenance, and performance levels in order to ensure the uninterrupted provision of multi-channel services. The Cable Television Board may report any deficiencies regarding these qualifications to the Council/franchising authority. Such performance evaluations may be conducted every three (3) years during the franchise term, and may be done as part of any required survey.
