(1) Where there is a conflict (actual or apparent) between this Chapter and an existing and applicable franchise agreement, the Chapter shall control, and prevail, unless administratively, or judicially determined invalid, unenforceable, or unconstitutional.

(2) Notwithstanding Subsection (1) of this Section, it is specifically noted that to the extent an MCS provider has received an exemption and/or relief from one (1) or more provisions of this Chapter, and the exact extent of such exemption and/or relief is reflected within the franchise agreement (as prescribed in Subsection 6.22.090 (5), Provo City Code), then the language in the franchise agreement shall control and prevail over any comparable language that may be contained within this Chapter.
