(1) Within thirty (30) days after the effective date of this Chapter designating a special distribution area, the Business License Office shall establish a date (the “cut-off-date”) by which application shall be made to the Business License Office for every newsrack proposed to be located within the special distribution area. No application shall be considered for the initial allocation that is filed later than the established cut-off date. The Business License Office shall give notice of the cut-off date by publication once in a newspaper of general circulation in the City not less than thirty (30) days prior to such cut-off date. The Business License Office shall also endeavor to mail notice of the cut-off date to the owners and/or distributors of publications currently located within the special distribution area as of the effective date of this Chapter designating the special distribution area; provided however, that failure to provide mailed notice to any person shall not invalidate any action taken pursuant to this Chapter.

(2) Once the initial distribution of publications occurs, the Business License Office shall accept applications to be considered for additional and/or future openings in the special distribution area.
